What is a work injury?

A "work injury" is any work-related harmful change in the human condition. It can be physical or mental impairment that substantially limits major life activities. Common injuries include a physical injury, disease, or mental health issue arising out of employment.

Who is a “worker” in terms of Workers’ Compensation?

A worker is anyone who earns a paycheck for exchange of time and labor. Usually these would be W-2 employees. If you are an independent contractor or self-employed you are not covered by the California Workers’ Compensation Act and you are excluded from benefits.

What is AOE/COE?

Arising out of employment and in the course of employment. This is the causational element of any workers’ compensation case. Your injury or illness must be caused by work. It can be 1% caused by work or 100% caused by work. 

Will CompSui represent me?

What is the Standard Plan (tier 1 service) best for?

Cases that are quickly approaching the 30 day window to report injuries caused by work. Filing an Application for Adjudication for cases that are quickly approaching the 1 year Statute of Limitations. It is best to seek attorney representation quickly thereafter or pay for the Pro Plan (tier II service) if you are confident to handle the claim on your own. People also use this method to file a claim before termination. If you feel there is a threat of getting terminated in immediate future, use this plan to protect your rights. 

What is the Pro Plan (tier 2 service) best for?

Injured workers who are able to self-advocate, learn, and want to limit fees paid for legal representation. Best for cases that are accepted (not contested); or not expected to be contested by the employer; or injuries that will resolve within 2 years or less. 

What is the Premier Plan (tier 3 service) best for?

Injured workers who are able to handle the claim on their own yet want the peace of mind they are adhering to the correct procedures by consulting with a licensed California attorney along the way.

What does CompSui mean?

CompSui is the combination of two concepts. Comp is an abbreviation for workers’ compensation. Sui is short for sui juris meaning, having full legal capacity to act on one’s own behalf. Our preferred pronunciation is comp-sue.
